Dakota County, in partnership with the City of Rosemount and the City of Apple Valley, are proposing safety improvements on County Road 38 (McAndrews Road) between County Road 31 (Pilot Knob Road) and Trunk Highway 3 (South Robert Trail). The proposed improvement will include a center left turn lane as well as right turn lanes at all intersecting public roadways. As part of the project, a small portion (0.35 acres) on the south portion of the Valleywood Golf Course will be impacted by the proposed project.
In accordance with Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) Public Law 109-59, enacted August 10, 2005, the Dakota County Transportation Department is soliciting comments on the effects this project would have on the Valleywood Golf Course. The project will impact less than one percent of the golf course property. None of the Valleywood Golf Course functions or facilities will be impacted by the proposed project.
It is anticipated that the Dakota County Transportation Department will request the Federal Highway Administration (FHWA) to determine that the proposed action at the Valleywood Golf Course is a Section 4(f) de minimis action in accordance with Section 6009(a) of SAFETEA-LU. A de minimis finding may be made when uses of Section 4(f) land will have no adverse effect on the protected resources.
