RESOLUTION NO. 12-19-17, THIRD SERIES
A Resolution of the City Council of the City of Hastings Authorizing Publication of a Summary of the Ordinance Amendment Regulating Rights-of-Way within the City of Hastings
WHEREAS, the Hastings City Council has passed an Ordinance Amendment Regulating the Use of Rights-of-Way within the City of Hastings and making certain modifications to the Zoning Code; and
WHEREAS, the Hastings City Charter provides that publication of ordinances may be accomplished by publishing in a newspaper of general circulation in the City, for at least two successive weeks, a notice that the ordinance has been passed which notice shall specify in a general manner the subject matter of the ordinance and shall further state that copies of the ordinance are available at the office of the City Clerk; and
WHEREAS, the City Council has determined that publication of the title and a summary of the ordinance would clearly inform the public of the intent and effect of the ordinance amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS, MINNESOTA, AS FOLLOWS:
The following summary publication shall be published in the manner required by the Hastings City Charter:

An Ordinance of the City of Hastings Regulating Rights-of-Way within the City of Hastings and Amending the Zoning Code to Regulate Small Wireless Facilities and Wireless Support Structures.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS:
HASTINGS CITY CODE CHAPTER 90, SECTION 90.07, IS AMENDED AS FOLLOWS: §90.07 RIGHT-OF-WAY MANAGEMENT.
On December 18, 2017, the Hastings City Council adopted a right-of-way management ordinance. The purpose of the ordinance is to regulate allowed uses within all public rights-of-way within the City, including the regulation of small wireless facilities and wireless support structures within public rights-of-way as either a permitted or special use within the Citys various zoning districts. The ordinance includes application requirements for permitting such facilities along with the review standards for small wireless facilities.
HASTINGS CITY CODE CHAPTER 155, SECTION 155.10, IS ADDED AS FOLLOWS: §155.10 SMALL WIRELESS FACILITIES AND WIRELESS SUPPORT STRUCTURES IN RIGHT-OF-WAY.
On December 18, 2017, the Hastings City Council also adopted a zoning ordinance amendment designated as City Code Section 155.10. The purpose of the ordinance is to designate small wireless facilities within right-of-way as permitted uses in all zoning districts, subject to certain regulations, and to designate wireless support structures within right-of-way as either special uses or permitted uses within various zoning districts within the City and subject to certain regulations. The ordinance also establishes height and placement restrictions for wireless support structures.
Copies of the ordinance are available for public inspection in the Office of the City Clerk during normal business hours or upon request by calling 651-480-2350.
Be it further resolved that the City Clerk is directed to keep a copy of the ordinance in her office at City Hall for public inspection and to post a full copy of the ordinance in a public place in the City for a period of two weeks.
Council member _____________________ moved a second to this Resolution, and upon being put to a vote it was adopted by a majority of all Council members present.
