MORTGAGE FORECLOSURE SALE
NOTICE IS HEREBY GIVEN, that default has occurred in the conditions of that certain Mortgage dated March 22, 2006, executed by John J. Bauer, a single man, as Mortgagor, to MidCountry Bank, as Mortgagee, filed with the Dakota County Recorder on March 31, 2006, as Document No. 2417250; and modified by a Modification Agreement dated April 11, 2007, executed by John J. Bauer, a single person, as Mortgagor, to MidCountry Bank, as Mortgagee, filed with the Dakota County Recorder on April 25, 2007, as Document No. 2512151.
That no action or proceeding has been instituted at law to recover the debt secured by said mortgage, or any part thereof; that there has been compliance with all notice provisions and conditions precedent as required by law; and that the mortgagee or assignee has elected to declare the entire sum secured by the note and mortgage to be immediately due and payable as provided in the note and mortgage;
That the original or maximum principal amount secured by the mortgage was Two Hundred Forty Thousand and no/100 DOLLARS ($240,000.00);
That there is due and claimed to be due on the mortgage, including interest to date hereof, the sum of Two Hundred Seventy-three Thousand Two Hundred Nineteen and 70/100 DOLLARS ($273,219.70);
And that pursuant to the power of sale therein contained, said mortgage will be foreclosed and the tract of land lying and being in the County of Dakota, State of Minnesota, described as follows, to-wit:
Lots 1, 2 and 3, together with that part of vacated Wilton Avenue which accrued thereto by reason of the vacation thereof, Block 22, Inver Grove Factory Addition, Dakota County, Minnesota.

Stat. § 582.32.

IF A JUNIOR CREDITOR FAILS TO TIMELY FILE A NOTICE OF INTENTION TO REDEEM, OR FAILS TO REDEEM, ITS LIEN ON THE REAL ESTATE IS EXTINGUISHED.
