NOTICE OF SHERIFF' S EXECUTION SALE OF REAL PROPERTY

Under and by virtue of an Execution issued out of and under the seal of the District Court of the State of Minnesota, in and for the First Judicial District and County of Dakota.

On the 20th day of August, 2012, upon a judgment rendered and docketed in said Court and said County in an action therein, between Berwald Roofing Company, Inc., plaintiff, and Merriam C. Last, defendant, in favor of said plaintiff and against said defendant for the sum of $45,045.70, as appeared by the judgment roll filed in the office of the Clerk of said District Court for said County of Dakota, and

WHEREAS, said judgment was docketed in the District Court of Dakota County on the day of 20th day of August, 2012, at 2:57 p.m. and the sum of $45,645.60 is now actually due thereon, with an interest per diem of $4.94, together with increased costs and for all Sheriff's Fees, costs and disbursements of levy. At the time of sale, additional costs may be incurred and added.

WHEREAS, said Execution has to me as Sheriff of Dakota County been duly directed and delivered and the Sheriff has served said Execution upon Defendant but no funds were collected upon demand,

PLEASE TAKE NOTICE that I have levied upon and will sell at public auction to the highest cash bidder, at the Sheriff's Main Office, Law Enforcement Center, 580 Highway 55, Hastings, MN 55033, County of Dakota, on the 26th day of February, 2013, at 10:00 a.m., all the right, title and interest in said above named Judgment Debtor that in and to the real property hereinafter on the 20th day of August, 2012, (that being the date of rendition of said judgment or any interest therein, which such Judgment Debtor Berwald Roofing Co., Inc. have since that day acquired, the description of the property being as follows, to-wit:

Lot 4, Block 1, Hungry Point Farm, Dakota County, Minnesota according to the plat thereof on file or of record in the office of the Register of Dakota Deeds in and for County, Minnesota.
