NOTICE IS HEREBY GIVEN, that under and by virtue of a Judgment and Decree entered on December 11, 2012 in Dakota County Court, a certified copy of which has been delivered to me directing the sale of the premises hereinafter described, to satisfy the amount found and adjudged due said Plaintiff in the foreclosure of the mortgage dated December, 5, 2005, executed by Defendants Michael Gibbons and Nancy Gibbons in favor of M & I Marshall & Ilsley Bank, filed in the office of the Dakota County Registrar of Titles on January 5, 2006, as Document No. 582405, and as assigned to Kondaur Capital Corporation by an Assignment dated August 4, 2009, filed of record June 10, 2010 in the Office of the Dakota County Registrar of Titles as Document No. 663172, and as further assigned to Plaintiff by an Assignment dated November 24, 2009, filed of record June 10, 2010 in the Office of the Dakota county Registrar of Titles as Document No.. 663173. As prescribed in the Judgment, the undersigned Sheriff of Dakota County will sell at public auction, to the highest bidder, for cash, on February 28, 2013, at 10:00 AM, in the main lobby of the Dakota County Law Enforcement Center, 1580 Highway 55, Hastings, Minnesota 55033, in the said County and State, the premises and real estate described in said Judgment and Decree, to wit:
All that tract(s) of parcel(s) of land lying and being in the County of Dakota and State of Minnesota, described as follows, to-wit;
LEGAL DESCRIPTION:Lot 16, Block 3, Berkshire Ponds, Dakota County,
Minnesota.
PROPERTY ADDRESS: 1926 Coving ton Lane, Eagan, MN 55122.
PROPERTY IDENTIFICATION NUMBER: 10-13750-03-160.
"THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED."
