NOTICE IS HEREBY GIVEN that, under, and by virtue of, that certain findings of fact, conclusions of law, order for judgment summary judgment and judgment and order entered on April 6, 2012 ("Order"), a certified copy of which has been delivered to me directing the sale of the Property, as hereinafter described, to satisfy the amount found and adjudged due to said Plaintiff in the above-entitled action from Defendants, Trang Tong and Luyen Le, d/b/a JT Hamburger (collectively "Borrowers"), as prescribed in the Order, with respect to that certain mortgage executed by executed by Borrowers, in favor of Park Midway Bank, N.A., a national banking association, f/k/a Park Midway Bank, f/k/a St. Anthony Park State Bank, dated March 4, 2004, and filed of record on May 25, 2004, as Document No. 537869, in the Office of the Registrar of Titles in and for Dakota County, Minnesota, the undersigned Sheriff of Dakota County, Minnesota, shall sell at public auction, to the highest bidder, for cash, on the 13th day of July, 2012, at 10:00 a.m., in the main lobby of the Dakota County Law Enforcement Center, 1580 Highway 55, Hastings, Minnesota 55033, in the said County and State, the following premises and real estate described in said Order, commonly known as 1224 Robert Street South, West St. Paul, Minnesota, PID No. 42-83790-00-210, and legally described as follows:

The North Thirty (N. 30) feet of Lot "A" Westchester Heights No. 1, and The South Eight (S. 8) feet of Lot Eight (8), Block Six (6), Westchester Heights No. 2 Re-arrangement, according to the recorded plats thereof. EXCEPTING and reserving, however, easements as follows, to-wit:

First-an easement over and across a portion of the above described premises, which portion lies between 2 parallel lines, extended, running diagonally in a general Southwesterly direction from the North line of said premises, the Southeasterly line of said easement extending from a point on the North line of said premises, which point is twenty-four (24) feet West of the Northeast corner of said premises, to a point on the South line of said premises, which latter point is forty-six (46) feet West of the Southeast corner of said premises, and the Northwesterly line of said easement being parallel to and thirteen (13) feet distant Northwesterly of the Southeasterly line of said easement.

Second-an easement over the South seven (S. 7) feet of that portion of above described premises, extending Easterly from a line 95.65 feet East of the Westerly line of said premises, to, abutting upon and adjoining with the Northwesterly line of said first described easement.

The purpose of said easements above described in paragraphs First and Second are to provide to John E. Blomquist, Inc. its successors and assigns, unobstructed ingress and egress to and from lands adjoining the said above described and conveyed premises.

Third-an easement for travel and for purposes of parking motor vehicles over the Westerly 95.65 feet of said above described conveyed premises.

Together with and subject to the benefits and burdens arising out of certain easement agreements on file in the Office of the Registrar of Titles in and for said County and State which agreements are identified as Document Numbered 9600, dated April 15, 1953, registered April 21, 1953, and Document Numbered 10392, dated February 9, 1954, registered February 10, 1954.

THE TIME ALLOWED BY LAW FOR THE REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
