IMPROVEMENTS

To Whom It May Concern:

Notice is hereby given that the City Council of Hastings, Minnesota will meet in the City Council Chambers, City Hall, 101 4th Street E, at 7:00 PM, Monday, March 19, 2012, to consider adoption of proposed assessments to properties abutting the 2012 Infrastructure Improvements program. The Hastings City Council will receive public comment on the assessments.

PROJECT 2012-1, 2012 INFRASTRUCTURE IMPROVEMENTS

This project includes various levels of street, utility, and curb and gutter, and sidewalk reconstruction and rehabilitation on 17th Street between Pine Street and Spring Street; on Eddy Street between 16th Street and 15th Street; on Ashland, Maple, and Walnut Streets between 18th Street and 15th Street; on Forest Street between 18th Street and 17th Street; and on Oak and Spring Streets between 18th Street and 16th Street. No new sidewalk segments are being proposed.

These improvements are to be considered and adopted pursuant to Minnesota Statutes, Chapter 429. The projects are proposed to be assessed on an area basis, on a unit basis, or on frontage basis against properties abutting or tributary to said improvements. The areas as specifically described herein are subject to said assessments.

The total improvement costs as of the date of this notice are estimated to be $3,005,313.84

The total amount of the proposed assessment for this project is $623,981.25, of which $24,000.00 is proposed to be assessed to City-owned property.

The public hearing before the City Council is scheduled for Monday, March 19, 2012 at the Hastings City Hall, 101 E. 4th St., at 7:00 PM. Such persons who desire to be heard with reference to the proposed assessments will be heard at such time and place. The City Council may adopt the proposed assessments at the public hearing.

Persons desiring to examine the exhibits and documents, including the assessment roll or persons having questions regarding their assessment may contact the Engineering Department at 1225 Progress Drive at (651) 480-2334. The office hours are 7 a.m. to 3 p.m. Monday through Friday. Copies of said exhibits and documents may be obtained by paying the cost for such materials. The proposed assessment roll is also on file for public inspection at the City Clerk's office, located at Hastings City Hall, 101 4th Street E, Hastings, MN.

Written or oral objections to the assessment roll by any property owner will be considered. No appeal to District Court may be taken as to the amount of any assessment adopted pursuant to Statute unless a written objection signed by the affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. An owner who is not precluded by failure to object prior to or at the assessment hearing may appeal an assessment to District Court pursuant to Minnesota Statute § 429.081 by serving notice of the appeal upon the Mayor or Clerk of the municipality within 30 days after the adoption of the assessment and filing such notice with the District Court within 10 days after service upon the Mayor or Clerk. As of the date of this notice, the City has not adopted any deferment procedure pursuant to Section 435.193 to 435.195 of State of Minnesota Statutes.
