NOTICE IS HEREBY GIVEN, that under and by virtue of that certain (i) Judgment made and entered in the above entitled action on March 11, 2011, docketed March 24, 2011; (ii) Summary Judgment made and entered on September 26, 2011, docketed November 10, 2011; and (iii) Partial Judgment made and entered on November 9, 2011, by the District Court of Dakota County, Minnesota, First Judicial District, certified copies of which have been delivered to me directing the sale of the premises hereinafter described to satisfy the sum of Thirty-one Thousand Nine Hundred Fifty-three and 15/100 ($31,953.15) Dollars and the costs and disbursements of said sale found and adjudged due Plaintiff in the above-entitled action from Defendant John D. Westley as prescribed in the aforementioned Judgments, the undersigned Sheriff of Dakota County will sell at public auction to the highest bidder for cash on Friday, the 9th day of March, 2012, at 10:00 a.m. at the Dakota County Sheriff's Office, Law Enforcement Center, 1580 Highway 55, Hastings, Minnesota 55033, the premises and real estate, lying and being in the County of Dakota, State of Minnesota, described in said Judgments, to wit:
Lot 1, Block 4, Town View First Addition
Registered Property Certificate of Title No. 65666
(the "Premises")
Property Address: 1747 Blue Bill Drive, Eagan, Minnesota 55122
PID No. 10-77100-010-04
The time allowed by law for redemption by Defendant, John D. Westley, or Defendant's personal representative or assigns is six months after the date said sale is confirmed by court order.
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE DEFENDANT, JOHN D. WESTLEY, THE DEFENDANT'S PERSONAL REPRESENTATIVE OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
