Summary for Publication

Nininger Township

The Board of Supervisors of Nininger Township adopted Ordinance No.14-A An Ordinance Amending Ordinance No. 14 Nininger Township Zoning Ordinance on December 20, 2011 and approved this summary for publication. Ordinance No. 14-A includes several sections, which are summarized as follows:

SECTION I The definition for "variance" is amended.

SECTION II Subdivision B. of Section 5.3 "Nonconforming Uses and Structures" is modernized to be consistent with State Statutes.

SECTION III Subdivision C. of Section 5.3 "Nonconforming Uses and Structures" is re-numbered from subdivision B.

SECTION IV Section 5.4 "Deadline for Actions" is added to be consistent with State Statutes.

SECTION V Section 6.1 "Enforcing Officer" is amended for clarification.

SECTION VI Section 6.3 "Board of Adjustment and Appeals" is amended to clarify the Planning Commission acts as the Board of adjustment and makes recommendations to the Town Board for Appeals, Interpretations and Variances.

SECTION VII Section 6.6 "Variances" is amended to be consistent with State Statutes and clarify the role of the Planning Commission and Town Board in reviewing variances.

SECTION VIII Section 6.7 "Building Permits" is amended to adopt the State Building Code, as amended, and clarify the role of the Building Official and indicate no optional appendices are adopted.

SECTION IX Section 6.0 "ADMINISTRATION" is amended by adding Section 6.8 Interim Use Permits.

SECTION X Section 7.2.4 Agriculture District "Conditional Uses," subsection C. is amended to allow a third single family farm dwelling in certain circumstances.

SECTION XI Section 7.2.5 Agriculture District "Prohibited Uses and Structures" is amended to read "Interim Uses" and establishes a new section for Interim uses in the Agriculture District.

SECTION XII Section 7.0 "ADMINISTRATION" is amended by adding Section 7.2.6 "Prohibited Uses and Structures," which was formerly numbered Section 7.2.5

SECTION XIII Section 7.3.5 Rural Residential District "Prohibited Uses and Structures" is amended to read "Interim Uses" and establishes a new section for Interim uses in the Rural Residential District.

SECTION IVX Section 7.0 "ADMINISTRATION" is amended by adding Section 7.3.6 "Prohibited Uses and Structures," which was formerly numbered Section 7.3.5

SECTION XV Section 9.5.5 "Animal Feedlot and Manure Handling Acreage and Setback Requirements - Minimum Setback Requirements" is amended by adding subsection 3. water well setback 100 feet.

SECTION XVI Section 10 "WATER AND SOIL RESOURCE MANAGEMENT" is amended by noting that water and soil resource management and wetlands regulations are contained in Ordinance No. 2010 Water Resources Management Ordinance.

SECTION XVII Section 11 "ON-SITE SEWER REQUIREMENTS" is renamed "Private Sewage Treatment System and Water Supply System Standards" and is updated to be consistent with State and County sewage treatment and water supply standards.

SECTION XVIII Section 15.8 "Dogs" is amended in its entirety by noting that dog regulations are contained in Ordinance No. 01-0 Nininger Township Dog Ordinance.

SECTION XIX Section 17.1 "Sign Regulations" is amended by noting that no sign in the Township shall exceed 80 square feet in area nor 20 feet in height.

SECTION XX Section 17.3 "On-site Advertising Signs" is amended by noting that all new signs larger than 40 square feet in area shall require an Interim Use Permit.

SECTION XXI Section 17.4 "Off-site Advertising Signs" is amended by clarifying that off-site advertising signs are prohibited except directional signs, which shall require an Interim Use Permit.

SECTION XXII Section 17.8 "Announcement Signs" is amended by changing the section title to read "Temporary Announcement Signs" and clarifying that all such temporary signage shall be promptly removed after the event for which they are allowed has concluded.

SECTION XXIII Ordinance No. 14 is amended by adding a new Section 21 Effective Date.

SECTION XXIV Ordinance No. 14-A was adopted on November 22, 2011 and becomes effective upon publication. Copies of Ordinance No. 14-A are on file with the Township Clerk.
