NOTICE IS HEREBY GIVEN that by virtue of the Findings of Fact, Conclusions of Law, Order for Default Judgment and Judgment entered in the above entitled matter, whereby it is adjudged, among other things, that there is due to the Plaintiff the sum of TWO HUNDRED THIRTY-SEVEN THOUSAND, NINE HUNDRED NINETY-FIVE AND 04/100 ($237,995.04) DOLLARS with interest through April 27, 2009, and that the land therein described be sold to satisfy the same, with costs and expensed of such sale, a certified transcript of which judgment has been delivered to me by the Court, I, the undersigned Sheriff of Dakota County, Minnesota will offer and expose for sale at public auction to the highest bidder on the 16th day of July, 2009 at 10:00 a.m. at the office of Dakota County Sheriff, 1580 Highway 55, Hastings, Minnesota, 55033 the land described and directed to be sold in said judgment lying and being in the County of Dakota, State of Minnesota, to wit:

Lots 19 and 20, in Block 11, in Addition No. Thirteen to the City of Hastings Dakota County, Minnesota

or so much thereof as shall be necessary to satisfy said judgment, the interest thereon, and the costs and expenses of such sale; subject to redemption within six (6) months for all other defendants and twelve (12) months for the United States of America from the date of confirmation of such sale. That Defendants Ronald Bathrick; Brenda Bathrick; Pamela Duncan; Jon Doe and Mary Roe are foreclosed and barred of all right, title and claim in or to the premises and every part thereof, save only the right to redeem the premises from said sale within six (6) months from the date of confirmation of such sale. The redemption period for the United States of America, Department of Justice shall be twelve (12) months from the date of confirmation herein pursuant to 28 U.S.C. 2410.

"THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED."

NOTICE OF SHERIFF'S EXECUTION SALE- REAL PROPERTY

Under and by virtue of an Execution issued out of and under the seal of the District Court of the State of Minnesota, in and for the First Judicial District and County of Dakota.
