NOTICE OF VOLUNTARY MORTGAGE FORECLOSURE SALE

NOTICE IS HEREBY GIVEN, that default has occurred in the conditions of a mortgage dated March 6, 2007, executed by Macik Properties, LLC, a Minnesota limited liability company, as mortgagor(s) to U.S. Bank N.A. as mortgagee in the original principal amount of Six Hundred Twenty-six Thousand Five Hundred ($626,500.00) Dollars, recorded with the Dakota County Registrar of Titles, State of Minnesota, on December 6, 2007, as doc. no. 621051; that the mortgage is upon registered land; that all pre-foreclosure requirements have been complied with; that no action or proceeding has been instituted at law to recover any part of the debt secured by said mortgage; that there is claimed to be due thereon the sum of Six Hundred Fifteen Thousand Two Hundred Seventy-six and 87/100 ($615,276.87) Dollars on this date; and that pursuant to the power of sale therein the mortgage will be foreclosed and the property in Dakota County, Minnesota, described as follows:

Units 4 and 5, CIC Number 569, Nicollet Plaza Retail Association, a Common Interest Community, located in Dakota County, Minnesota.

Together with all buildings, structures, standing timber, timber to be cut, fixtures, furnishings, inventory, equipment, machinery, apparatus, appliances, and personal property located on and used in connection with the land and improvements, materials, contracts, drawings and personal property relating to any construction on the land, improvements located thereon; easements, rights-of-way, licenses, privileges and appurtenances; lease and other agreements for the use or occupancy of the Premises and all rents, issues, profits or any proceeds therefrom; all security deposits, awards for condemnation, eminent domain or other decrease in value of the Premises, insurance and other proceeds of the Premises; and any interest of Mortgagor in the land lying within any roadway, strips and gores adjoining the Premises.

will be sold by the sheriff of said county at public auction on May 31, 2013, at 10:00 o'clock A.M. at Sheriff's Office, Law Enforcement Center, 1580 Highway 55, Hastings, Minnesota, to pay the debt secured by the mortgage, including costs and attorneys' fees allowed by law subject to redemption by the mortgagor(s), its heirs or assigns, within two (2) months from the date of sale.

This notice pertains to a voluntary foreclosure proceeding pursuant to Minn. Stat. §582.32 pursuant to an Agreement for Voluntary Foreclosure dated April 5, 2013. Each holder of a junior lien may redeem in the order and manner provided in §582.32 subd. 9, beginning after the expiration of the mortgagor's two month redemption period.
