NOTICE IS HEREBY GIVEN, that under and by virtue of an Execution issued by the District Court of the State of Minnesota, for the Third Judicial District and County of Rice on the 26th day of December, 2012, upon a judgment rendered and docketed in said Court and County in the above-referenced case on February 26, 2010, in favor of Plaintiff, The State Bank of Faribault and against Defendants Layton C. Hoysler and Gevine E. Hoysler, for the principal amount of $686,856.77, as appears in the judgment roll filed in the office of the Clerk of said District Court for said County of Rice; and

WHEREAS, said judgment was then docketed on March 22, 2010, in the District Court of Dakota County, Court File No. 19HA-CV-10-1469, and the sum of $834,310.22 (which includes an execution fee of $55.00, and interest computed to December 26, 2012 of $147,398.45) is now actually due thereon, plus additional interest incurred after December 26, 2012 at the judgment interest rate of 10% per annum, up to and including the date of sale and all of my fees, costs, and disbursements of levy and sale, and

WHEREAS, said Execution was to me as Sheriff of Dakota County duly directed and delivered on April 30, 2013 at 9:35 a.m., at which time I levied upon the property described therein pursuant to Minnesota Statutes, Section 550.11, by making a minute on the Execution, stating the time when it was delivered to me.

PLEASE TAKE NOTICE, that I have levied upon and will sell at public auction, to the highest bidder, for cash, on the 18th day of July, 2013, at 10:00 o'clock a.m., at the Dakota County Sheriff's Office located at 1580 Highway 55, Hastings, Minnesota, 55033, all right, title and interest that Defendants Layton C. Hoysler and Gevine E. Hoysler had on the 22nd day of March, 2010 (that being the date of docketing of said judgment in Dakota County) in and to the real estate hereinafter described, or any interest therein which said that Defendants Layton C. Hoysler and Gevine E. Hoysler have since that day acquired, the description of the property being as follows, to-wit:

Outlot D, Cherry Highland Third Addition, Dakota County, Minnesota.

The real property's street address is: N/A.

The real property's identification number is: 22-17052-00-040.

The judgment debtors (Layton C. Hoysler and Gevine E. Hoysler), the debtors' heirs, successors, legal representatives, or assigns may redeem within one year after the day of sale by paying, to the purchaser or the officer making the sale, the amount for which the property was sold with interest at the rate stated in the certificate of sale, together with any costs as provided in Minnesota Statutes, Sections 582.03 and 582.031.
