NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated December 27, 2001, executed by Mohamed Ibro and Kedija Osman, husband and wife, as mortgagors, to Twin Cities Habitat for Humanity, Inc. as mortgagee, recorded in the office of the County Recorder of Dakota County, on March 14, 2002, as Document No. 1873541, which mortgage conveyed and mortgaged the following described property, situated in the County of Dakota and State of Minnesota:
Lot 2, Block 1, Broback Sixth Addition, Dakota County, Minnesota.
To the best of the knowledge of the party foreclosing the mortgage, the common address of the property is 14835 Dallara Ave. Rosemount, MN 55068 and the property identification number is 34-15205-01-020. The name of the lender is Twin Cities Habitat for Humanity, Inc. and the name of the servicer is AmeriNational Community Services, Inc. If the mortgage is not reinstated under section 580.30 or the property redeemed under section 580.23, the time to vacate the property is 11:59 P.M. on July 9, 2014.
That the original principal amount secured by said mortgage was $ 108,667.00; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any regulation or statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $ 71,805.03 and together with taxes on said premises paid in the amount of $ 916.51 making a total amount due thereon as of the date of this notice of $ 72,721.54.
That by virtue of the power of sale contained in said mortgage, the said mortgage will be foreclosed by the sale of the above described premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Dakota County, Minnesota, in the Dakota County Law Enforcement Center, 1580 Highway 55, Lobby No. S-100 in said County on January 9, 2014, at 10:00 AM, at public auction to the highest bidder, to pay the amount then due on accordance with the provisions of said mortgage. The time allowed by law for redemption by the mortgagors or the personal representatives or assigns of the mortgagors is 6 months from the date of said sale.
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR\'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
