NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE

YOU ARE NOTIFIED THAT,

1. Default has occurred in the conditions of the Declarations of Regatta Courthomes Association II, Dakota County, Minnesota, by Troy Anderson, as fee owner of the below-described property subject to said Declarations.

2. Pursuant to the Declarations of the Regatta Courthomes Association II filed for record with the Dakota County Recorder on September 15, 2000 as Document No. 1717956, and all amendments thereto, and Minnesota Statutes, a statutory lien exists for unpaid assessments and fees incurred from June 1, 2008 to the date of this notice.

3. No action or proceeding has been instituted at law to recover the debt secured by the statutory lien or any part thereof, or if an action has been instituted it has been dismissed or discharged prior to the commencement of these proceedings.

4. The holder of the lien has complied with all conditions precedent to acceleration of the debt secured by the assessment lien and foreclosure of said lien, and all notice and other requirements of applicable statutes.

5. As of the date of this notice the amount due, after acceleration pursuant to the Association's Declarations and By-laws, is $3,488.00.

6. As of the date of this notice, the names of all parties that have been released from liability for the assessment lien are as follows: NONE.

7. Pursuant to the provisions of the Declarations of the Regatta Courthomes Association II, the lien will be foreclosed and the land located at 15840 Fleet Trail, Apple Valley, Minnesota 55124, in the County of Dakota, State of Minnesota, legally described as follows:

Unit 357, CIC No. 280 Regatta Court Homes II will be sold by the sheriff of said county at public auction on August 13, 2009, at 10:00 a.m., at the Dakota County Sheriff's Office, Law Enforcement Center, 1580 Highway 55, Hastings, Minnesota 55033 in said county and state, to pay the debt then secured by said lien, including any additional assessments and late fees that may become due through the date of sale, along with the costs, attorneys fees and disbursements allowed by law.

8. The time allowed by law for redemption by the mortgagors, or mortgagor's personal representatives or assigns is six (6) months after the date of said sale.

Said amount includes the unpaid annual assessment installments, a portion of an insurance premium assessment, late charges, costs of collection, and attorney's fees incurred by the Association in collection of said amount due (all of said unpaid amounts are collectively referred to hereinafter as the "Debt"), all as assessed to and levied against said property by the Association pursuant to the Declaration and Minnesota Statutes Chapter 515B ("Chapter 515B"). Pursuant to Chapter 515B and the Declaration, the Debt creates a lien in favor of the Association against said property.

DATE AND PLACE OF RECORDING OF LIEN: The verified Lien Statement in favor of the Association is dated December 1, 2008, and was recorded in the Recorder's office on December 31, 2008, as Document No. 2628900.

All pre foreclosure requirements have been complied with by the Association. There are no actions or proceedings instituted at law by the Association to recover the Debt or any part thereof. The Lienee has not been released from his personal obligation to pay the Debt.

Restated Declaration of The West Forty Homeowners Association(hereinafter the "Association") which was recorded as Document No. 1839189 on December 12, 2001, in the office of the County Recorder of Dakota County, Minnesota, and also, pursuant to Minn.
