NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE

YOU ARE NOTIFIED THAT:

1. Default has occurred in the terms and conditions of the Amended and

Restated Declaration of The West Forty Homeowners Association(hereinafter the "Association") which was recorded as Document No. 1839189 on December 12, 2001, in the office of the County Recorder of Dakota County, Minnesota, and also, pursuant to Minn. Stat. §515B.3-116, covering the following property:

Lot 1, Block 1, The West Forty Plat 1, and Part interest in Lot 7, Block 1 and Outlot A Area, Common Interest Community Number 290

2. Pursuant to said Declaration, there is claimed to be due and owing as of

June 15, 2009, from the owner of said unit,(Kelly Kratzke, Barbara J. Kratzke and Robert A. Kratzke or other such persons who are title holders) to the Association, a Minnesota non-profit corporation, the amount of $7,937.90 for unpaid association dues, late fees, attorneys fees and costs, plus any other such amounts that will accrue after June 15, 2009 for costs of collection and foreclosure which will be added to the amount claimed due and owing at the time of the sale herein, plus accelerated dues.

3. No action is now pending at law or otherwise to recover said debt or any part

thereof.

4. The owner has not been released from their financial obligation to pay said

amount.

5.The lien arises pursuant to the Declaration, describes above, Minn. Stat.

§515B.3-116 and is further described in a Notice of Lien in favor of the Association recorded on April 2, 2009 as Document No. 2647513 in the Dakota County, Recorder's Office.

6. Pursuant to the power of sale contained in the same Declaration and granted by the owner in taking title to the premises subject to said Declaration and pursuant to Minn. Stat. Sec. 515B.3-116, said Lien will be foreclosed by the sale of said property by the Sheriff of Dakota County, at the Dakota County Sheriff's Office, 1580 Highway 55, Hastings , MN on August 12, 2009 at 10:00am at public auction to the highest bidder, to pay the amount then due for said assessments, together with the additional costs of foreclosure, including attorneys fees as allowed by law.

NOTICE OF ASSESSMENT LIEN

FORECLOSURE SALE

THIS COMMUNICATION IS FROM A DEBT COLLECTOR. THIS COMMUNICATION IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

NOTICE IS HEREBY GIVEN THAT default has been made in the terms and conditions of the Amended and Restated Declaration of Birnamwood Homes recorded in the office of the County Recorder in and for Dakota County, Minnesota (the "Recorder"), as Document No. 1377559, as amended by Document No. 2458732 (collectively the "Declaration"), and the Amended and Restated By-Laws (the "By-Laws") of Birnamwood Homes Association (the "Association").

LEGAL DESCRIPTION OF PROPERTY:

Lot 2, Block 2, Birnamwood Plat 5, Common Interest Community No. 170, Dakota County, Minnesota.

ADDRESS OF PROPERTY: 101 Birnamwood Drive, Burnsville, Minnesota 55337.

TAX PARCEL IDENTIFICATION NUMBER OF PROPERTY: 02-14004-020-02.

LIENEE: Damion Frelix (the "Lienee").

LIENOR: Birnamwood Homes Association, a Minnesota nonprofit corporation.

AMOUNT DUE AND CLAIMED TO BE DUE TO THE ASSOCIATION ON THE LIEN DESCRIBED HEREIN, ON THE DATE OF THIS NOTICE: $6,365.05.

Said amount includes the unpaid annual assessment installments, a portion of an insurance premium assessment, late charges, costs of collection, and attorney's fees incurred by the Association in collection of said amount due (all of said unpaid amounts are collectively referred to hereinafter as the "Debt"), all as assessed to and levied against said property by the Association pursuant to the Declaration and Minnesota Statutes Chapter 515B ("Chapter 515B"). Pursuant to Chapter 515B and the Declaration, the Debt creates a lien in favor of the Association against said property.

Pursuant to the Declaration, the Bylaws, and Chapter 515B, the Lienee (or his Estate) is financially obligated to pay to the Association the Debt, as well as all assessments and/or installments thereof (as may be accelerated by the Association), late charges, fines, costs of collection and foreclosure, attorney's fees incurred by the Association in collection of the Debt and in foreclosure of the Association's lien against said property, and all other amounts, which the Association assesses to and levies against said property from and after the date of this Notice, which additional amounts are part of said lien and are subject to this foreclosure.

DATE AND PLACE OF RECORDING OF LIEN: The verified Lien Statement in favor of the Association is dated December 1, 2008, and was recorded in the Recorder's office on December 31, 2008, as Document No. 2628900.

All pre foreclosure requirements have been complied with by the Association. There are no actions or proceedings instituted at law by the Association to recover the Debt or any part thereof. The Lienee has not been released from his personal obligation to pay the Debt.

Pursuant to the power of sale granted by the Lienee in taking title to said property as provided in Chapter 515B and the Declaration, said lien will be foreclosed by the sale of said property by the Sheriff of Dakota County, Minnesota, at the office of the Dakota County Sheriff, Dakota County Law Enforcement Center, 1580 Highway 55, S100, Hastings, Minnesota, on August 11, 2009, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for all unpaid assessments or installments thereof (as may be accelerated by the Association), late charges, fines, costs of collection and foreclosure, attorney's fees, and all other amounts, assessed to and levied against said property by the Association through the date of said sale. The time allowed by law for redemption by the Lienee, his personal representatives or assigns, is six months from the date of said sale.

REDEMPTION NOTICE

THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE LIENEE, OR THE LIENEE'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE LIENED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
