for 2006 Street and Utility Improvements

TO WHOM IT MAY CONCERN:

Notice is hereby given that the City Council of Hastings, Minnesota will meet in the City Council Chambers, City Hall, 101 East 4th Street, at 7:00 p.m. on Monday, November 5, 2007 to consider the proposed assessments for the following 2006 Improvement Projects:

Project 2006-1 3rd Street Area Improvements

The improvements included reconstruction of 3rd Street west of Vermillion Street (TH 61), Eddy Street between 2nd Street and 5th Street, Ashland and Prairie Street between 2nd Street and 3rd Street, and Forest, Maple and State Streets between 3rd Street and 4th Street. The improvements would include street reconstruction with concrete curb and gutter, new construction and reconstruction of storm sewers, and sanitary sewer and water main replacements would also be included. A new sidewalk along the west side of Eddy Street is proposed, and most other sidewalks would be replaced in their current locations with new materials. Decorative lighting would also be installed along Eddy Street.

Property abutting the aforementioned streets in the area described above is legally described as follows, and is proposed to be assessed for these improvements:

Project 2006-2 North Frontage Road Water System Improvements

These improvements included watermain construction, street reconstruction with spot concrete curb and gutter replacement, some storm sewer construction/replacement, sanitary sewer construction, and bituminous pavement milling and overlay.

Property abutting the aforementioned streets in the area described above is legally described as follows, and is proposed to be assessed for these improvements:

Project 2006-3 Industrial Park 7th Addition Improvements

This project included site grading, street construction with concrete curb and gutter, watermain construction, sanitary sewer construction, and storm sewer construction for Lightborne Court in the Industrial Park 7th Addition Plat.

Property abutting the area described above that is proposed to be assessed is legally described as follows:

Lots 1-3 and Lots 7-12, Block 2, Hastings Industrial Park No. 7

The proposed assessment roll is on file in the office of the City Engineer and will be available for public inspection to all persons interested beginning October 16, 2007. Written or oral objections to the assessment roll by any property owner will be considered. No appeal may be taken as to the amount of any assessment adopted pursuant to Statute unless a written objection signed by the affected property owner is filed with the City Clerk prior to the hearing. An owner may appeal an assessment to District Court by serving notice of the appeal upon the Mayor or Clerk of the municipality within 30 days after the adoption of the assessment and filing such notice with the District Court within 10 days after service upon the Mayor or Clerk. As of the date of this notice, the City has not adopted any deferment procedure pursuant to Section 435.193 to 435.195. The City Council may adopt the proposed assessments at the public hearing.

The total amount of the proposed assessment is hereby declared to be $929,678.46
