Assault with knife is charged against Hastings man
Hastings Police have charged David Clark Kelly, 48, Hastings, with one count of terroristic threats and one count of assault in the fifth degree. The charges were filed following a Nov. 19 incident at a Hastings bar.
According to the criminal complaint, Hastings Police were called to the bar on the report that someone had been assaulted with a knife. The suspect had fled the bar.
The victim told police that while he was ordering drinks, an individual, later identified as Kelly, had assaulted him with a knife. The victim said he and Kelly had no issues during the conversation. He said Kelly had come up behind him and grabbed him by the neck and threatened to cut his throat. The victim pushed Kelly's hand away, and in the process, sustained a deep cut on his thumb.
Two friends verified the victim's account.
Officers were able to apprehend Kelly, who was walking in the area. He had a knife in his pocket.
When asked, Kelly apparently told the officer that the victim had been bothering him. He said he put the knife to the victim's throat, but denied cutting him.
